Career Summary
The study addresses the need for a precise alignment of the concept of ḍarūrah and ḥājah in attaining maṣlaḥah with the principles of maqāṣid al-Sharīʿah within the context of Islamic Banking and Finance. This alignment is crucial due to ongoing debates regarding the proper application of ḍarūrah and ḥājah in pursuing the maṣlaḥah within IBF. Through an in-depth analysis of various Islamic financial contracts, the study showcases specific shortcomings in how ḍarūrah and ḥājah are currently applied in the industry. The findings highlight several factors that contribute to these shortcomings. In response, the thesis – after rigorous analyses – proposes new frameworks for product development and the categories of ḍarūrah and ḥājah to better suit the needs of the global IBF industry.
